Terms for a shared family space.

Independent signup, creating a family, and administering household access require age 18 or older and authority to agree to these Terms. You must provide accurate age and account information. Do not use an adult account or change a birth date to bypass safeguards. Owners must not authorize unrelated children as a parent or legal guardian.

• Ages 0–5 - young children: parent-managed profiles only. No direct sign-in or AI.
• Ages 6–12 - children: direct sign-in requires verified parental consent. AI is unavailable to this age group, including the Learning helper. A checkbox or pending verification request alone never enables direct sign-in.
• Ages 13–17 - teens: a parent or legal guardian must authorize supervised sign-in. AI is unavailable to this age group, including accounts with earlier parental AI approval or teen assent.
• Ages 18 and older - adults: public signup and adult permissions. Each eligible adult makes their own AI choice for the exact account and family, after age and provider readiness checks.

Age is derived from date of birth, not a user-selected label. Missing or inconsistent minor age information blocks direct access. Permission is checked again when the age band, family, account, or controlling notice changes; it is not silently carried into a new category. An existing supervised account does not automatically become an adult account at 18.

AI permission is separate from permission to use the core app. Children and teens cannot use any AI, including the Learning helper, AI file or voice uploads, AI actions, connected external accounts, or adult health and nutrition AI features. Guest accounts cannot use AI. These restrictions also apply during testing.

A family can keep a parent-managed profile without enabling a login or AI. Verification and permission are scoped to the person, household, feature, and current notice. You may not transfer a permission or use another member's credentials. These controls are requirements, not a guarantee of legal compliance for every use you choose.

Provide accurate account information and keep it current. Protect passwords, devices, recovery channels, invitation links, and any login created for another family member. Do not share an account with a person who is not authorized to use it. Tell us promptly if an account or family space may be compromised.

Kulaya may rely on instructions from an authenticated account until we have reason to believe it has been compromised. You are responsible for activity performed through your account to the extent permitted by law. We can require reauthentication or additional verification for a sensitive action.

A family space is shared. Core roster information can be visible to people with access to the family, while particular modules and actions can have additional restrictions. The owner and parent administrators are responsible for invitations, roles, linked logins, and removing access that is no longer appropriate.

Administrative access does not automatically give an adult legal authority to consent for another adult, access every confidential record, or submit information the adult has no right to share. Add another person's health, school, contact, photo, communication, or other sensitive information only when you have authority and the disclosure is appropriate for the family space.

Family relationships and authority can change. If there is a custody, guardianship, separation, safety, or access dispute, stop adding disputed information and contact support. Kulaya does not decide legal custody or guardianship and can require documentation or preserve data when reasonably necessary for safety or law.

You retain ownership of information and materials you submit, including family profiles, events, lists, records, notes, photos, documents, messages, and other content. You grant Kulaya a limited, worldwide, non-exclusive licence to host, copy, process, transmit, format, and display that content only as reasonably needed to operate, secure, support, and provide the features you request and to follow your instructions.

The licence ends when the content is deleted from active systems, subject to the retention, backup, security, legal, and shared-family limitations described in the Privacy Policy. Kulaya does not obtain a licence to sell family content, use it for targeted advertising, or train a general-purpose model for an unrelated purpose merely because you submitted it.

You represent that you have the rights and permissions needed to submit the content. Do not upload confidential, copyrighted, intimate, medical, school, or third-party material unless you are authorized to do so and the intended family members may appropriately receive it.

You may not use Kulaya to:

• break a law, violate another person's rights, or facilitate harm;
• harass, threaten, exploit, groom, sexualize, or endanger a child or any other person;
• upload malware, probe security, bypass access controls, or disrupt the Service;
• access another account, family space, member record, or connected service without authorization;
• submit information you obtained unlawfully or are not authorized to disclose;
• scrape, copy, resell, or commercially exploit the Service except through a written agreement;
• reverse engineer the Service except where applicable law expressly permits it;
• send spam, impersonate another person, or provide materially deceptive information;
• use AI output to make an unlawful, discriminatory, medical, or high-impact automated decision; or
• use automated systems in a way that creates unreasonable load, evades limits, or harms users.

We may investigate suspected misuse and take proportionate steps to protect users and the Service, including limiting a feature, preserving relevant security records, suspending access, or reporting conduct when legally required.

Kulaya can let you connect Google Sign-In, Google Calendar, Gmail, an internet calendar feed, inbound email, or another service. Connections are optional. You authorize Kulaya to process the information and permissions shown during the connection flow and described in the Privacy Policy. Calendar and Gmail integrations request read-only Google access. Kulaya does not receive a Google password.

Completing a Google Calendar connection or import, adding an internet calendar feed, and later eligible manual or app-open syncs retrieve event content. Automatic OpenAI calendar classification is currently disabled. Connecting Gmail alone does not authorize AI processing. Separate email-summary permission lets DeepInfra analyze approved-sender messages you select, or newly arriving matching messages after a separate background opt-in. Approved-sender messages can concern school, work, household, or other topics; approving a sender does not restrict analysis to school messages. Pasted or forwarded messages also need that separate permission and authority to share their content. Calendar suggestions always require review. After email analysis, Kulaya does not retain the selected body, but can retain the message identifier, subject, sender, and processing status or outcome to prevent duplicate imports and track the result. Supervised child and teen logins cannot connect or use Google Calendar or Gmail.

Third-party services have their own terms and can change, limit, suspend, or end access. You are responsible for keeping those accounts and source URLs authorized and secure. Kulaya is not responsible for a third-party service, its content, or a change outside our control. Disconnecting a source may leave an approved, imported, or edited family record until that record is separately deleted.

Kulaya offers two separately authorized AI purposes for eligible adults aged 18 or older. All AI features, including the Learning helper, are unavailable to anyone under 18. Parental approval does not override that restriction. Guest accounts cannot use AI. Non-AI family features retain their separate age and access rules.

Reduced general assistant: OpenAI. GPT-5.6 Terra processes only the adult's current typed or dictated question and its answer. We do not attach earlier chat messages, stored family records, school-email content, files, or images. This mode cannot read or change app data, browse the web, or execute tools. Do not submit children's information, private family details, contact information, or sensitive health information. Local screening reduces accidental disclosure but cannot reliably identify every kind of personal information in free text.

Existing Gemini permissions do not authorize OpenAI processing. Earlier full-assistant permissions do not authorize either new limited purpose. Each requires its own current notice and choice.

OpenAI also performs input and output safety moderation. We send an opaque safety identifier, not a raw email or account ID. API content is not used for model training by default. Kulaya's OpenAI Zero Data Retention request is pending, not approved: standard provider safety retention can apply. Disabling response storage is not ZDR. The full family-data assistant, uploads, and automatic OpenAI calendar classification remain disabled pending their separate privacy and readiness checks. See OpenAI's API data controls.

Email summaries: DeepInfra. With a separate adult permission, DeepInfra processes message text and subjects using DeepSeek V4 Flash to produce private summaries, importance assessments, action lists, and suggested calendar dates. Messages can concern school, work, household, or other topics; an approved sender is not a school-only filter. We do not send the stored family roster or email attachments, follow links, or automatically approve calendar changes. Email content is not sent to OpenAI. Only use this feature for information you are authorized to share, including any child information in an email.

Connecting Gmail alone does not authorize AI processing. You must save approved senders and select matching messages for manual analysis, or separately opt into checks about every ten minutes for newly arriving messages. Pasted or forwarded email also requires the separate email-summary AI permission. There is no automatic historical backfill. Empty checks do not call AI. The current pilot limits attempts and shares the household AI allowance; frequency is not a delivery guarantee or an emergency service.

Kulaya does not retain raw email bodies after processing. Private summaries, message identifiers, subjects, senders, proposed dates, and processing outcomes can remain until deleted. DeepInfra's terms prohibit training on customer content and limit content retention, with support, security, and legal exceptions. Technical prompt caching may apply; Kulaya does not request extended cache retention. It is not a promise that no data is ever retained, or a claim of U.S.-only processing. Review or withdraw each permission separately in Settings → AI & family permissions. Background email checks can also be paused in Gmail settings. Withdrawal blocks future requests, but a transmission already sent cannot be recalled. General chat can remain in the current device's local history until cleared; it is not forwarded as conversation context. Permission, usage, and security records are retained as described in this policy. None of these choices authorizes another person's account.

AI is not a person, therapist, emergency service, or professional adviser. Safeguards cannot guarantee every answer is safe or correct. Check original messages and review proposed dates before accepting them. Do not rely on AI output for diagnosis, treatment, or medical, legal, financial, or high-impact decisions. In the U.S., call 911 for immediate danger or call/text 988 for a suicide or mental-health crisis.

You must review AI output before relying on it or approving a suggested action. AI is not medical, legal, financial, investment, or emergency advice. You remain responsible for decisions and for ensuring you have authority to submit information. Do not use Kulaya AI for unlawful conduct, harmful instructions, exploitation, manipulation, or high-impact decisions about another person.

Kulaya is a consumer family organizer. It is not a licensed health care provider and does not furnish professional health care, emergency services, legal services, therapy, dietetic care, or another professional service. Its health, nutrition, parenting, school, and safety features are intended for organization and general information, not as a medical device or to diagnose, treat, cure, or prevent disease. They do not create a professional relationship. A law may nevertheless classify certain consumer-health software as a provider for that law's privacy and confidentiality requirements.

During controlled prelaunch testing, eligible users can add, change, import, synchronize, review, and delete person-linked health and nutrition information. These features are optional. Use test data where possible, review family visibility, and submit another person's information only when authorized. Enabling a feature does not convert its records or output into professional advice or establish authority over another person's data.

Verify medications, allergies, vaccines, lab values, appointments, measurements, and nutrition guidance with an appropriate professional. Do not delay seeking care because of Kulaya content. If someone may be in danger or is experiencing an emergency, call 911 in the United States or the appropriate local service.

Kulaya is currently offered directly to families, not by or on behalf of a school. Information a family enters, photographs, forwards, or imports is family-provided information. Kulaya is not the school's official gradebook or student record and should not be treated as the authoritative school source.

A school or district must not direct students to use Kulaya or disclose protected education records to Kulaya without an appropriate written agreement, authority, notice, and privacy review. A future school service would require separate terms and controls.

Kulaya is evolving. We can add, change, limit, or remove a feature; update device or browser requirements; impose fair usage or security limits; or interrupt access for maintenance, security, or circumstances outside our control. We will try to give reasonable notice when a material change is likely to significantly affect active users.

Some features depend on a network connection, device storage, or third-party provider. Offline and synchronization features reduce disruption but are not a guaranteed backup. Keep independent copies of information you cannot afford to lose.

Kulaya does not currently charge for the public version of the Service. If a paid feature is introduced, the price, billing period, included features, trial terms, automatic renewal, cancellation method, taxes, and refund rules will be shown before purchase.

A purchase through Apple, Google, or another app marketplace is also governed by that marketplace's billing terms. Digital mobile features will use the payment method required by the applicable platform. Paid terms will be added before Kulaya accepts payment.

The Service, including software, design, brand, logo, text, arrangement, and materials supplied by Kulaya, is owned by Kulaya or its licensors and protected by intellectual-property law. Subject to these Terms, Kulaya gives you a limited, personal, revocable, non-exclusive, non-transferable licence to use the Service for its intended family-organization purpose.

If you send ideas or feedback, you permit Kulaya to use them without restriction or payment, but you keep ownership of rights you already hold. Do not submit feedback containing another person's confidential information or material you are not authorized to share.

If you download Kulaya from an app marketplace, the marketplace operator is not a party to these Terms and is not responsible for Kulaya, support, maintenance, warranties, or claims, except as its own terms require. Your licence to use the mobile app is limited to devices and accounts permitted by the marketplace rules.

You represent that you are not located in a place, and are not a person, prohibited from receiving the Service under applicable U.S. sanctions or export-control law. Platform-specific terms control if they provide a nonwaivable right that conflicts with this section.

You may stop using Kulaya at any time. You can request permanent account deletion from the Account page, from Settings when available to your role, or by emailing support@kulaya.app. Signing out, resetting local app data, disconnecting a service, removing a family member, and deleting an account are different operations. The Privacy Policy explains deletion and shared-family consequences.

We may restrict or suspend access when reasonably necessary to protect a person, comply with law, address a security risk, prevent material abuse, enforce provider restrictions, or enforce these Terms. Where practical, we will give notice and a chance to correct the issue. We can terminate access for serious or repeated violations.

Terms that by their nature should continue after termination survive, including ownership, disclaimers, liability limits, dispute terms, and obligations relating to prior conduct.

To the fullest extent allowed by law, the Service is provided “as is” and “as available.” Kulaya disclaims implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, and warranties arising from course of dealing or usage of trade.

We do not promise that the Service will always be available, secure, error-free, or accurate; that content will never be lost; that a connected service will continue; or that AI output will be correct. Nothing in these Terms excludes a warranty or consumer protection that cannot lawfully be excluded.

To the fullest extent allowed by law, Kulaya and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or use, arising from or related to the Service, even if advised that the harm was possible.

To the fullest extent allowed by law, Kulaya's total liability for all claims arising from or related to the Service will not exceed the greater of the amount you paid Kulaya during the 12 months before the event giving rise to the claim or 100 U.S. dollars.

These limits do not apply to liability that cannot be limited under applicable law. Some states do not allow certain exclusions or limits, so part of this section may not apply to you.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Kulaya and its personnel from third-party claims, losses, and reasonable expenses arising from your unlawful use of the Service, your material violation of these Terms, or content you submit without required rights or permissions. This does not apply to the extent a claim results from Kulaya's own conduct or where applicable law prohibits it.

Before filing a formal claim, you and Kulaya agree to make a good-faith effort to resolve it informally. Email a description of the dispute and requested relief to support@kulaya.app. Either party may proceed after 30 days if the matter is not resolved. This process does not prevent a person from contacting a regulator or seeking urgent relief.

These Terms are governed by New Jersey law, without regard to conflict-of-law principles. A judicial proceeding not eligible for small claims court will be brought in a state or federal court in New Jersey, and each party consents to personal jurisdiction there. This section does not waive a consumer protection, venue right, or remedy that cannot lawfully be waived in the consumer's state.

We can update these Terms as Kulaya or law changes. We will update the date and provide additional notice when a change is material or law requires it. A change applies prospectively from its stated effective date.

Continued use after an ordinary notified change takes effect means you accept the revised Terms. Continued use alone will not replace affirmative agreement or consent where applicable law requires a new choice.

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent, except where applicable law permits. Kulaya may transfer them in connection with a merger, financing, reorganization, or sale of the business, subject to applicable privacy and notice requirements.

These Terms, the Privacy Policy, applicable supplemental notices, and terms presented for a specific paid or connected feature form the agreement about the Service and replace prior statements about the same subject.
